The California “No Contest” Clause Meets SLAPP — The Battle of Competing Policy. 

The speaker will be Hon. Glen M. Reiser (Ret.) 

California has long been in the minority of jurisdictions authorizing the use of "no contest" clauses to deter litigation challenging the efficacy of testamentary and trust instruments.  Applicable law has become extraordinarily complicated through successive legislative attempts to refine permissible uses of the clause. Meanwhile, California "anti-SLAPP" laws have likewise become complex, again through legislation, protecting the exercise of a litigant's right to petition for the redress of grievances. The two public policies, one deterring litigation and the other promoting litigation rights, have now come into direct conflict. This course will address how a probate/trust practitioner can navigate these conflicting policies and still effectively represent their client.  Register Now!
