Probate Code §3100 Petitions: How and When to Use Them.

In this presentation, Kimberly R. McGhee, Esq. will provide an overview of Probate Code §3100 Petitions and how best to use them in your practice. These petitions are used to manage, sell or gift jointly owned assets and/or create or fund a revocable living trust when one spouse becomes incapacitated. They are also commonly used for long-term care planning to increase eligibility for public benefits.  You will learn their benefits and the manner in which you can use them to avoid conservatorships in a crisis. Ms. McGhee will also provide you with the tips and tricks of working with the Guardian Ad Litem to ensure a successful outcome. For those of you who are appointed as Guardian Ad Litem in these matters, you will also obtain information on how to evaluate the Petition and provide a thoughtful analysis to the court.
